Please read these Terms and Conditions ("Terms") carefully before using our website and engaging in our web-building services. These Terms govern your access to and use of our website and services provided by Boondock Media. By accessing or using our website and services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use our website or services.

1. Website Plans

1.1 Monthly Plan:
Under the Monthly Plan, users pay a monthly fee for 12 months to cover the total cost of the website, hosting, and maintenance. After the first year, users will be billed $97 per month for hosting and maintenance services.

1.2 Quarterly Plan:
Under the Quarterly Plan, users pay a discounted rate on a quarterly basis for the same services as the Monthly Plan. The quarterly payment covers the total cost of the website, hosting, and maintenance for the specified period.

1.3 All In Plan:
Under the All In Plan, users pay the full amount of the website upfront, followed by the normal $97 per month for hosting and maintenance services.

2. Other Services

2.1 Add-On Service Billing:

Subscriptions for Add-On Services (i.e. Content Marketing, Social Media Management, PPC Advertising) that are bundled with a Quarterly Plan are billed every three months through the 12th month of service. After that point, they are billed monthly. Monthly Plan and All In Plan add-ons are billed monthly from the start of service.

2.2 Standalone Service Billing:

Standalone services that are added without a website plan are billed monthly from the start of service.

3. Ownership of Website and Content

3.1 Monthly and Quarterly Plans:
For users under the Monthly Plan and Quarterly Plan, full rights to the website, including the code and all associated files and content, including blogs created under a Content Marketing subscription, remain with Boondock Media until the website is paid in full after 12 months. Once the website is paid in full, all rights to the website will be transferred to the customer.

3.2 All In Plan:
For users under the All In Plan, full rights to the website, including the code and all associated files and content, will be transferred to the customer upon payment of the full amount.

3.3 Add-On Service Content

Full rights to all content created and distributed within a subscriber's website remain with Boondock Media until the website is paid in full in the 12th month of service. Once the website is paid in full, ownership of all website files and associated content will be transferred to the subscriber.

3.4 Standalone Service Content

All standalone service content not associated with a website plan belongs to the subscriber from the start of service.

4. Payment and Cancellation

4.1 Payment:
Users agree to pay the specified fees according to the chosen plan and/or applicable add-on services. Payments are processed through our secure payment gateway. We may use third-party payment processors to handle these transactions, and their terms and conditions may apply.

4.2 Cancellation of Website Plan:
If a Monthly Plan or Quarterly Plan is canceled before the website has been paid in full at the 12th month, ownership of the website and all files and associated content will remain with Boondock Media until the remaining balance is rendered. If an add-on Content Marketing service associated with said plans exists, it would be canceled as well. Any additional add-on services would remain unless otherwise canceled by the subscriber.

If an All-In plan is canceled, ownership and all rights associated with the website, files and content would remain with the subscriber. Any add-on services associated with said plan would remain unless canceled by the subscriber. 

Any services that are canceled will remain in effect until the end of the pre-paid period.

4.3 Cancellation of Add-On or Standalone Services

Any add-on or standalone services that are canceled will remain in effect until the end of the pre-paid period. Website plans associated with a canceled add-on service will remain in effect unless otherwise canceled by the subscriber.

4.4 Refunds For Services Rendered

Boondock Media does not offer refunds for any services rendered.

5. Intellectual Property

5.1 Ownership:
All intellectual property rights, including copyrights and trademarks, associated with our website and services, including the website design, graphics, logos, and software, remain the property of Boondock Media or its licensors.

5.2 Prohibited Use:
You may not use, reproduce, distribute, modify, or create derivative works of any materials found on our website or provided as part of our services without our prior written consent.

6. Limitation of Liability

To the maximum extent permitted by law, Boondock Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use or inability to use our website or services, including but not limited to damages for loss of profits, data, or other intangible losses.

7. Termination

We may terminate or suspend your access to our website and services at any time and without prior notice for any violation of these Terms or for any other reason.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of South Carolina. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Carolina.

9. Changes to the Terms

We reserve the right to update or modify these Terms at any time without prior notice. By continuing to access or use our website and services after any revisions become effective, you agree to be bound by the revised Terms.

10. Indemnification

You agree to defend, indemnify, and hold Boondock Media harmless against any and all claims, losses, damages, liabilities, costs, and expenses, including attorneys' fees, arising from or in connection with your use of boondockmedia.com or any violation of these Terms.

11. Rights to Deny Service

Boondock Media retains the absolute and sole discretion to deny, cancel, terminate, suspend, restrict, or modify access to (or control of) any goods or services, at its own discretion and for any reason.
